PriceProof: EU Omnibus — Terms of Service

These Terms govern your ("Merchant", "you") use of the PriceProof: EU Omnibus application ("the App") provided by Gyutae Oh (sole proprietor) ("we", "us"). By installing the App you agree to these Terms.
The App records your store's product price history, computes the lowest price applied over a prior period, displays it on your storefront, flags discount-percentage inconsistencies, and lets you export your price history. The App is a compliance-support tool; it helps you display prior-price information relevant to EU Directive 98/6/EC Art. 6a (the "Omnibus" price-indication rule) as transposed by individual member states.
The App does not provide legal advice. Legal requirements — including whether a given item requires a prior-price display, and how, in a given country — vary by member state and change over time. For example, Poland extends the obligation to services while Germany and the Netherlands apply it to goods only. You are solely responsible for determining what your business must display and where.
You are solely responsible for: selecting the correct country rule/settings for your target markets; verifying that the displayed prior price and any discount percentage are correct before publishing a price reduction; and complying with obligations the App does not cover (e.g. reductions announced in email, banners, or off-storefront advertising). The obligation under Art. 6a / national law binds you as the trader, not us as the tool provider.
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted or error-free operation, or that its output satisfies any specific legal requirement. Price history depends on data Shopify delivers via webhooks; gaps or delays in that data may affect computed values. We do not guarantee, ensure, or represent that use of the App makes you compliant with any law.
You will not use the App to display a prior price you know to be false, to overstate a reduction, or in any manner intended to mislead consumers. The App computes values deterministically from your price history and provides no manual price-override capability by design.
We process the data described in our Privacy Policy (shop domain, shop-owner contact details, and product price data). We do not collect or store consumer personal data. On uninstall we delete your data within 30 days per our deletion procedure. A Data Processing Agreement is available on request.
To the maximum extent permitted by applicable law, and except for liability that cannot be limited by law:
(a) our aggregate liability arising out of or related to the App is limited to the total subscription fees you paid for the App in the twelve (12) months preceding the event giving rise to the claim;
(b) we are not liable for indirect, incidental, consequential, or special damages, or for lost profits, lost revenue, or fines or administrative penalties imposed on you by any authority;
(c) nothing in this section excludes or limits liability for intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body or health, or any other liability that may not be excluded or limited under the applicable mandatory law of your jurisdiction (including, where German law applies, liability for breach of cardinal obligations to the extent of typical foreseeable damage).
Shopify is not a party to this agreement, is not responsible for the App, and is not liable for any fault in the App or harm resulting from its installation or use.
Either party may terminate by uninstalling / discontinuing the App. We may update these Terms with reasonable prior notice; material changes give you the right to terminate before they take effect.
These Terms are governed by the laws of the Republic of Korea, without prejudice to any mandatory consumer- or B2B-protection provisions of the Merchant's country of establishment that apply notwithstanding a choice of law. Disputes not otherwise resolved are subject to the exclusive jurisdiction of the Seoul Central District Court (서울중앙지방법원), Republic of Korea.
